Understanding supported living leases

A landlord's introduction to the commercial terms that matter.

Supported living is often associated with longer-term leases and greater tenant responsibility than conventional residential lettings. Those features can be attractive, but they are not universal. The actual lease offered must be read on its own terms.

Who is the tenant?

Depending on the model, the legal tenant may be a Registered Provider/Housing Association, supported living care provider, children's home provider or another relevant housing organisation.

Lease length

Longer lease terms can occur in the sector, but there is no single standard term. Renewal options, break rights and termination provisions can materially change the headline term.

Repairs, maintenance and insurance

Some agreements place substantial repairing and maintenance responsibilities on the tenant or provider. Others divide obligations differently. Insurance can also be structured differently.

Rent reviews

Index-linked reviews occur in agreements seen by TSLC, but the index, frequency, floors and caps can differ. The wording of the particular lease matters.

Professional review

TSLC can coordinate the commercial opportunity and progression, but the final legal agreement should be reviewed by the parties and their appropriate professional advisers.
